What is a Bayh-Dole Scofflaw?
The Bayh-Dole Act is the law that enables inventors and the companies they work for to retain the title to inventions created while working on a government contract, a grant or a cooperative research and development agreement (CRADA). If you own the patent you own the exclusive right to commercialize and receive royalties for these inventions.
Bayh-Dole Scofflaws are entities, usually defense contractors and a few universities and biomedical researchers, whose patents and patent applications do not contain a complete government interest statement as required by the Bayh-Dole Act. These government interest statements acknowledge receipt of taxpayer funding but don't contain a contract number, or the name of the agency that provided the funding. There are also incidents where the assignee provides incomplete contract numbers. When this data is missing it is impossible to track how much money these people received and who it came from. FedInvent does its best to research and find the funding sources for these taxpayer-funded patents.
